Privacy Policy

1. Data controller

The controller responsible for the personal data collected through this website is Ivanof García Espigares, with Spanish tax ID (NIF) 75150653-Q, domiciled at Carrer Niceto Alcalá Zamora, nº 8, 2º, 07011, Palma, Illes Balears, Spain.

For any question regarding the protection of your data, you can write to privacidad@evahome.app. No Data Protection Officer has been appointed, as it is not required given the volume and nature of the processing carried out.

2. What data we process and why

a) Information request form. When you fill in the "Request information" form on this website, we process your name, email, your relationship to the person who would live with EVA Home, the type of home, whether you have wifi, and whether there is a pet at home. This data is used to respond to your enquiry, assess the installation and, if you give us your consent, send you commercial information about our own products or services similar to those requested. The legal basis is your consent (art. 6.1.a GDPR) and, where applicable, taking pre-contractual steps at your request (art. 6.1.b GDPR). Commercial communications rely on art. 21.2 of Spanish Law 34/2002 (LSSI-CE).

b) Data collected by the home sensors, once the service is contracted. If you contract EVA Home, the sensors installed at the home collect data about presence, temperature, humidity, door and window opening/closing, the installation address, inactivity, and device battery level. This data is processed exclusively to provide the monitoring and notification service contracted, under the data processing agreement signed with whoever contracts the service. The legal basis is the performance of that contract (art. 6.1.b GDPR).

If you contract EVA Home for someone else's home (for example, your mother, father or grandparent), it is your responsibility to inform them that their presence, movement and inactivity at home will be monitored, and to make sure there is an appropriate legal basis for it — their consent or, if they cannot give it, that of their legal representative. EVA Home has no direct relationship with that person unless they contract the service themselves.

The app includes a temporary pause feature intended for visits, and using it is the responsibility of whoever contracts the service.

3. Recipients of the data

We do not share your data with third parties except where legally required. To manage the contact form we use Google Workspace (Gmail) as our email provider, which acts as a data processor. Google LLC adheres to the EU-U.S. Data Privacy Framework, which ensures an adequate level of protection for data transfers to the United States when they occur.

We also use Google Analytics to understand, in aggregate, how this website is used, but only if you give us your consent through the cookie notice. You can see exactly which cookies we use, how long they last, and how to change your decision in our Cookie Policy.

Data collected by the home sensors is processed under the data processing agreement signed with each customer, and is not shared with third parties except as set out in that agreement (for example, maintenance work carried out with express authorization).

4. Retention period

Contact form data is kept while we handle your enquiry and, if no contract is ultimately signed, it is deleted once it is no longer needed for that purpose or when you request its deletion. If you agreed to receive commercial communications, your data is kept until you withdraw your consent.

Data linked to a service contract is kept for the duration of the contractual relationship and, afterwards, for the legally applicable limitation periods: up to 5 years under art. 1964 of the Spanish Civil Code, or up to 6 years under art. 30 of the Spanish Commercial Code for accounting or invoicing records.

5. Your rights

You can exercise your rights of access, rectification, erasure, restriction of processing, objection, portability, and withdrawal of consent at any time by writing to privacidad@evahome.app and providing identifying information. You also have the right to lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) if you believe the processing of your data does not comply with the regulations.

6. Security measures

We apply appropriate technical and organizational measures to protect your data against unauthorized access, loss or alteration, including access controls, strong passwords, and regular backups.

7. Changes to this policy

We may update this policy to reflect legal changes or changes to our services. The date of the last update appears at the top of this page.
